Occupational health and safety (OHS) legislation around the world imposed personal liability on officers and senior managers of companies. That liability, in some cases, applies extra-territorially – in the sense that US based officers of global companies may be liable for offences committed by their company in foreign jurisdictions. This paper will explore those liabilities.

A partir del 2012, OSHA revisó el Programa de Comunicación de Peligros (HCS por sus siglas en inglés) para incluir el Sistema Globalmente Armonizado (GHS por sus siglas en inglés). Esta modificación va en conformidad con el Sistema Globalmente Armonizado para clasificar y etiquetar químicos de las Naciones Unidas. Los países que han adoptado el GHS para transportar químicos peligrosos y están actualmente trabajando para implementarlo incluyen: México, Filipinas, Perú, Serbia, Brasil, Chile, Argentina, entre otros. Muchos ya han adoptado el GHS entre ellos Estados Unidos, Canadá y las Naciones Europeas.


S71 Are You Up To Date With GHS?: A Guide to the Globally Harmonized System and OSHA's Hazard Communication Standard, Diana Cortez and Elisonia Valle

OSHA revised the Hazard Communication Standard to include the new Globally Harmonized System (GHS) which became effective on May 25, 2012. This modification conforms to the United Nations’ GHS of Classification and Labeling of Chemicals. Currently, countries that have adopted the GHS for the transport of dangerous goods and are working on full implementation include Mexico, Philippines, Peru, Serbia, Brazil, Chile, Argentina, and others. Many have already adopted the GHS such as United States, Canada and the European Union.
